It has come to the attention of Broker Risk Management (“BRM”) that testers are currently contacting agents with listings for leases and inquiring as to whether the owners will accept Section 8 vouchers. If the agent or owner answers, “no,” the matter is immediately referred to the Department of California Civil Rights. If that occurs, the Department will open an investigation, many times leading to monetary settlements. The Department may also refer the matter to the Department of Real Estate for a separate investigation.

As a reminder, Section 8 tenants are a protected class and owners, property managers, and agents may not discriminate against them.

In 2023, BRM provided a webinar regarding fair housing. Fair housing is a mandatory annual training required by the California Department of Real Estate. This webinar can be used to fulfill the requirements of that training.
